These terms govern your use of nutraelmt.co and any purchase you make from it. The site is operated by Dynamic Health Group LLC ("Nutra Elmt", "we", "us"). By using the site or placing an order you accept these terms.
1. Eligibility
You must be at least 18 years old and able to enter into a binding contract. By ordering you confirm that you are.
2. Our products are dietary supplements
Women Bloom is a dietary supplement. It is not a drug and it is not intended to diagnose, treat, cure, or prevent any disease.
These statements have not been evaluated by the Food and Drug Administration.
Nothing on this site is medical advice, and nothing on this site replaces the judgement of a qualified healthcare professional. Consult your physician before use if you are pregnant, nursing, taking medication, or living with a medical condition. Discontinue use and seek advice if you experience an adverse reaction. Keep out of reach of children.
Biotin can interfere with certain laboratory tests. Tell your physician you are taking this product if you have blood work scheduled.
3. Individual results vary
Testimonials and customer experiences shown on this site reflect the experience of individual people. They are not a promise, a guarantee, or a prediction that you will obtain the same outcome.
4. Orders and acceptance
Your order is an offer to buy. We accept it when we dispatch the goods. We may refuse or cancel any order, including where a product is unavailable, where a pricing or description error has occurred, or where we suspect fraud. If we cancel an order you have already paid for, you receive a full refund.
5. Pricing
Prices are shown in United States dollars and may change without notice. Any comparison price shown alongside a bundle is the total price of the same number of bottles bought individually at their current single-unit price.
We make every effort to display prices accurately. If an error occurs, we will contact you before dispatch and you may confirm the order at the corrected price or cancel it.
6. Subscriptions and automatic renewal
Some products are offered on an AutoShip (subscription) basis.
By selecting an AutoShip option and completing checkout, you are enrolling in a recurring purchase that renews automatically until you cancel it, and you authorize us to charge your saved payment method on each renewal date at the renewal price shown at checkout.
The frequency, the price of your first order, and the price of subsequent renewals are displayed on the product page and again at checkout before payment. Introductory pricing applies to the first order only.
You may cancel at any time, without fee, through your account portal, through the "Manage Subscription" link in the footer of our website and in every subscription email, or by emailing support@nutraelmt.co. A cancellation takes effect on future orders only and must be completed before a renewal is processed in order to stop that renewal.
Our Subscription Policy governs reminders, cancellation cutoffs, price changes, and failed payments, and forms part of these terms.
7. Shipping and returns
Delivery is covered by our Shipping Policy. Returns and refunds are covered by our Refund Policy. Both form part of these terms.
8. Product information
We take care to describe our products accurately, including ingredients, quantities and origin. Photographs are illustrative. Ingredient amounts are stated at time of manufacture and natural variation may occur, as noted on the label.
9. Intellectual property
The Nutra Elmt and Women Bloom names and logos, the text, photographs, illustrations and design of this site belong to us or our licensors. You may not copy, reproduce or use them commercially without our written permission.
10. Acceptable use
You agree not to use the site unlawfully, not to attempt to gain unauthorised access to it, not to interfere with its operation, and not to extract its content by automated means for commercial purposes.
11. Third-party links
Where the site links to other websites, we are not responsible for their content or their privacy practices.
12. Disclaimer of warranties
The site and its content are provided "as is". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. This does not limit any warranty that cannot be excluded under applicable law.
13. Limitation of liability
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to your purchase, the products, or your use of the site is limited to the amount you paid for the single order giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, whether based in contract, tort, warranty, or any other theory, even if we have been advised of the possibility of such damages.
Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
14. Indemnity
You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.
15. Arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.
Agreement to arbitrate. Except where prohibited by law, any dispute, claim, or controversy between you and Dynamic Health Group LLC arising out of or relating to these terms, your purchase, our products, our advertising, or your use of the site — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved by final and binding individual arbitration, and not in court.
Informal resolution first. Before initiating arbitration, you agree to give us written notice describing the claim and the relief sought, sent to Dynamic Health Group LLC, 1309 Coffeen Avenue, Suite 1200, Sheridan, Wyoming 82801, United States. If the dispute is not resolved within thirty (30) days of receipt, either party may initiate arbitration.
Rules and forum. The arbitration is governed by the Federal Arbitration Act. It will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in the capital city of the state in which you reside, or may proceed by telephone or on documents where the amount claimed does not exceed $10,000 and you so elect.
CLASS ACTION WAIVER. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
JURY TRIAL WAIVER. YOU AND WE WAIVE ANY RIGHT TO A TRIAL BY JURY.
Exceptions. Either party may bring an individual action in small claims court. Either party may seek injunctive relief in court to protect intellectual property rights. Nothing here prevents you from reporting a matter to a government agency.
Opt out. You may opt out of this arbitration agreement by sending written notice, within thirty (30) days of your first order, to the address above, stating your name, the email address on your order, and that you opt out of arbitration. Opting out does not affect any other part of these terms.
Severability and survival. If the class action waiver is found unenforceable as to a particular claim, that claim shall proceed in court and all other claims remain in arbitration. This section survives termination of your relationship with us.
16. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules. Subject to the arbitration section above, the state and federal courts located in Wyoming have exclusive jurisdiction, save that consumers may bring proceedings in the courts of their own state where applicable law gives them that right.
17. Changes
We may amend these terms. The version in force is the one published on this page at the time you place your order.
